DMCA Copyright Policy
Welcome to the official Digital Millennium Copyright Act (DMCA) Policy page for FixMySpeaker-Sound.com. As a digital platform focused on acoustic engineering, device recovery utilities, and educational tech content, we hold a profound respect for the intellectual property rights of creators, developers, audio engineers, and writers across the global internet.
This comprehensive policy outlines how FixMySpeaker-Sound.com complies with the provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512) and international copyright frameworks. It details the precise procedures for reporting alleged copyright infringement on our platform, as well as the steps for submitting a counter-notification if you believe your content or audio files were removed in error. By using our website, you acknowledge and agree to the protocols set forth in this legal document.
Our Commitment to Intellectual Property
FixMySpeaker-Sound.com operates with a strict mandate to ensure that all original content, including our proprietary acoustic sine wave files, troubleshooting articles, and website design, is lawfully produced and utilized. In turn, we are equally committed to ensuring that our platform does not host, distribute, or promote content that infringes upon the exclusive rights of external copyright holders.
While our primary service involves mathematical audio calculations and specific frequency generation created by our audio engineer, David Miller, we also host educational articles and graphical assets. If you are a copyright owner, or an authorized agent acting on behalf of one, and you believe that any material hosted on FixMySpeaker-Sound.com violates your intellectual property rights, we have put in place a formal, streamlined process for you to report these concerns directly to our administrative team.
Designated Copyright Agent
To ensure that all legal notices are handled promptly and by the appropriate personnel, FixMySpeaker-Sound.com has appointed a designated point of contact for all intellectual property matters. All DMCA takedown notices and counter-notifications must be directed to our operational headquarters.
Physical Address FixMySpeaker-Sound.com Attn: DMCA Copyright Agent Mushk Mahal, Attapur Hyderabad, Andhra Pradesh 500064 India
Phone Number 040 6535 4435
Note: We highly recommend submitting your DMCA notices via email to ensure the fastest possible processing time. Physical international mail may experience processing delays.
Filing a DMCA Takedown Notice
If you believe in good faith that your copyrighted work (including but not limited to proprietary audio files, written text, or code) has been reproduced, distributed, or displayed on FixMySpeaker-Sound.com without your authorization in a way that constitutes copyright infringement, you must submit a formal, written communication to our Designated Copyright Agent.
To be considered legally valid under the DMCA (17 U.S.C. § 512(c)(3)), your takedown notice must include all of the following specific elements. Failure to include any of these required components may result in your request being delayed or dismissed entirely.
1. Authorized Signature
Your notice must include the physical or electronic signature of the copyright owner or a person explicitly authorized to act on behalf of the owner of the exclusive right that is allegedly infringed. A typed name at the bottom of an email is generally accepted as an electronic signature.
2. Identification of the Copyrighted Work
You must provide a clear, detailed description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works. If the work involves a specific audio frequency or acoustic file, please provide evidence of original creation. Providing the copyright registration number is helpful but not legally required.
3. Identification of the Infringing Material
You must provide a clear description of the material that you claim is infringing upon your rights and that is to be removed or access to which is to be disabled. Crucially, you must provide the exact, specific URL(s) (web addresses) on FixMySpeaker-Sound.com where the allegedly infringing material is located. General statements or directing us to our homepage are insufficient; we must be able to locate the specific text, image, or audio player in question.
4. Contact Information
We require adequate information to permit our Designated Copyright Agent to contact you regarding your complaint. This must include your full legal name, your mailing address, your telephone number, and a valid email address.
5. Statement of Good Faith
Your notice must include a statement asserting that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its legally appointed agent, or the law (e.g., that it does not qualify as “Fair Use”).
Example: “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.”
6. Statement of Accuracy and Penalty of Perjury
Your notice must conclude with a statement that the information in the notification is completely accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Example: “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
How We Process Takedown Notices
Upon receiving a fully compliant DMCA takedown notice at our official administrative email address, FixMySpeaker-Sound.com will take the following actions:
Review and Verification: Our technical and administrative teams will review the submission to ensure all required elements of the DMCA are present and that the links provided point to active pages on our domain.
Expedited Removal: We will act expeditiously to remove, or disable access to, the material that is alleged to be infringing.
Notification to the Poster: If the allegedly infringing content was provided by a third-party user or external contributor, we will take reasonable steps to promptly notify that individual that the material has been removed or disabled. We will also provide them with a copy of the DMCA notice so they understand the exact reason for the takedown.
Filing a DMCA Counter-Notification
If you are a user or contributor to FixMySpeaker-Sound.com and you believe that your content was removed (or access to it was disabled) as a result of a mistake, misidentification, or an invalid copyright claim, you have the right to file a DMCA Counter-Notification.
To be legally effective, your counter-notification must be a written communication sent to our Designated Copyright Agent and must include all of the following elements:
1. Your Signature
Your physical or electronic signature.
2. Identification of the Removed Material
A clear identification of the material that has been removed or to which access has been disabled, and the specific URL or location at which the material appeared before it was removed or disabled.
3. Statement Under Penalty of Perjury
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
Example: “I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification.”
4. Contact Information and Consent to Jurisdiction
Your full name, physical address, telephone number, and email address. Because our operations are international, you must also include a statement that you consent to the jurisdiction of the federal or appropriate regional courts in the judicial district in which your address is located (or the appropriate courts in Hyderabad, India, where our physical headquarters are located). Furthermore, you must state that you will accept service of process from the person who provided the original DMCA takedown notification or an agent of such person.
Processing Counter-Notifications
When we receive a valid counter-notification, our Designated Copyright Agent will promptly forward a copy of it to the original complaining party. We will inform them that we will replace the removed material or cease disabling access to it in ten (10) business days.
FixMySpeaker-Sound.com will restore the removed material and restore access to it between ten (10) and fourteen (14) business days following receipt of the counter-notice, unless our Designated Copyright Agent first receives formal notice from the original complaining party that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our platform.
Repeat Infringer Policy
In strict accordance with the Digital Millennium Copyright Act and other applicable intellectual property laws, FixMySpeaker-Sound.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the access privileges or accounts of users, contributors, or partners who are deemed to be repeat infringers.
We may also, at our sole discretion, limit access to the site and/or terminate the contributions of any users who infringe any intellectual property rights of others, regardless of whether there is any repeat infringement.
Legal Warning Regarding False Claims
Please be advised that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to severe civil liability and held liable for damages. This includes costs and attorneys’ fees incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by FixMySpeaker-Sound.com, if we are injured by such misrepresentation.
We strongly advise that you consult with a qualified legal professional before submitting a DMCA Takedown Notice or a Counter-Notification to ensure that you fully understand your legal rights and obligations.
